Asim ibn Humayd narrated from Muhammad ibn Qays, who said: I asked Imam عليه السلام about a man who bequeathed a portion of his wealth - a third or a fourth - to another man. Then, the man (the testator) was mistakenly killed. Imam عليه السلام said: "The will is to be executed from his wealth and from his blood money (diyyah)."

In another narration, Abu Abdullah عليه السلام, was asked about a man who had bequeathed one-third of his wealth and was then killed by mistake. Imam عليه السلام said: "One-third of his blood money (diyyah) is included in his bequest."
