Chapter on What Necessitates Discretionary Punishment, Legal Punishment, Stoning, Execution, and Exile in Adultery
In the narration reported by Al-Hasan ibn Mahbub from Ali ibn Riʾab from Abu Ubaydah from Abu Jafar عليه السلام, regarding a man upon whom a legal punishment (hadd) was due but he was not punished until he became mentally disturbed. Imam عليه السلام said: "If he had confessed to the hadd upon himself while he was sound in mind and free from any mental illness, then the hadd must be carried out on him regardless of his current state."
