Chapter on Judgment Regarding the Enclosure Between Two Houses

سَأَلَ مَنْصُورُ بْنُ حَازِمٍ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ: عَنْ حَظِيرَةٍ بَيْنَ دَارَيْنِ فَذَكَرَ "أَنَّ عَلِيّاً عَلَيْهِ اَلسَّلاَمُ قَضَى بِهَا لِصَاحِبِ اَلدَّارِ اَلَّذِي مِنْ قِبَلِهِ اَلْقِمَاطُ".

Mansur ibn Hazim asked Abu Abdillah about a courtyard situated between two houses. Imam mentioned that Imam Ali ibn Abi Talib ruled that it belongs to the owner of the house from whose side the boundary rope (al-qimat) extends.

Hadith #2

وَ رَوَى عَمْرُو بْنُ شِمْرٍ عَنْ جَابِرٍ عَنْ أَبِي جَعْفَرٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ عَلِيٍّ عَلَيْهِ اَلسَّلاَمُ: أَنَّهُ قَضَى فِي رَجُلَيْنِ اِخْتَصَمَا إِلَيْهِ فِي خُصٍّ فَقَالَ "إِنَّ اَلْخُصَّ لِلَّذِي إِلَيْهِ اَلْقُمُطُ".

Amr ibn Shimr narrated from Jabir, from Abu Ja'far Imam Muhammad ibn Ali Al-Baqir , from his father, from his grandfather, from Imam Ali ibn Abi Talib : He ruled in a case where two men disputed over a reed fence (khuss). Imam Ali ibn Abi Talib said: "The fence belongs to the one to whom the boundary rope (al-qimat) is attached."

Commentary #1

قَالَ مُصَنِّفُ هَذَا الْكِتَابِ رَحِمَهُ اللَّهُ الْخُصُّ الطُّنُ الَّذِي يَكُونُ فِي السَّوَادِ بَيْنَ الدُّورِ وَ الْقَمْطُ هُوَ شَدُّ الْحَبْلِ يَعْنِي أَنْ يَكُونَ الْخُصُّ هُوَ الَّذِي إِلَيْهِ شُدَّ الْحَبْلُ وَ قَدْ قِيلَ إِنَّ الْقِمَاطَ هُوَ الْحَجَرُ الَّذِي يُغْلَقُ مِنْهُ عَلَى الْبَابِ.

The compiler of this book (may Allah have mercy on him) explained that the 'khuss' refers to a structure made of reeds, commonly found in rural areas between houses. The 'qimat' is the fastening of a rope, indicating that the ownership of the fence is determined by whose side the rope is tied. Some have also said that 'qimat' refers to a stone used to secure the door.
